Because the previous HOA framework was drafted before the recent tightening of French regulations regarding rentals and anything that could be interpreted as a commercial activity in residential buildings. Under the new rules, any structure that appears to “provide services” (cleaning, linen, turnover, etc.) can be treated as a rental operator or a hotel-like activity. To avoid this reclassification—and to ensure the HOA remains purely residential—these operational items now need to be handled outside the HOA and recorded through a separate POS structure belonging to the Management Coordinator company. This separation is one of the reasons the bylaws were updated.
